Terms of service

These terms are an agreement between you and Windshield Software LLC (“Windshield”, “we”). By creating an account you accept them.

The service

Windshield turns a recording or a block of text about a sales visit into a written summary, a suggested next action and a draft email. It is a drafting aid. You are responsible for reading what it produces before you use it.

Your account

You need a working email address. Keep access to that inbox secure, since anyone with it can sign in as you. One account per person. Tell us promptly if you think your account has been used without your permission.

Your content

You keep ownership of everything you put into Windshield and everything it generates for you. You grant us the limited licence needed to store that content and process it through our service providers so we can operate the product. Nothing more.

Your responsibility for what you submit

You represent that you have all rights, permissions and consents necessary to submit content to Windshield, and to allow Windshield and its service providers to process that content.

Recording laws vary by state and country, and some require the consent of everyone present. Windshield is designed for you to speak to your own phone after a visit, alone — but whatever you submit, obtaining the necessary permission is yours to do, not ours.

Health information

Do not submit protected health information (PHI) or other data subject to HIPAA unless Windshield has expressly agreed in writing to support that use. We are not a HIPAA business associate and have no Business Associate Agreement in place by default.

Acceptable use

You may not use Windshield for unlawful purposes, to violate another person’s privacy or intellectual-property rights, to process information you do not have permission to use, to compromise or interfere with systems or security, or otherwise in violation of Windshield’s acceptable-use requirements. Because Windshield is built on third-party AI services, their usage policies also apply to content you submit.

Specifically, you agree not to use Windshield to:

• Record anyone without the consent the law where you are requires.
• Submit content you do not have the right to process, including confidential information belonging to someone else.
• Break the law, or infringe anyone’s privacy, contract or intellectual property rights.
• Upload or generate unlawful, harassing, defamatory or deliberately deceptive content.
• Attempt to gain unauthorised access to the service, other accounts, or the systems behind them; probe, scan or test our security without written permission; or interfere with service availability.
• Introduce malware or any other harmful code.
• Reverse engineer, decompile or attempt to derive the source code or underlying models, except where that restriction is prohibited by law.
• Resell, sublicense or provide the service to others as your own, or use automated means to scrape it.
• Circumvent usage limits, rate limits or billing.

We may suspend an account that breaks these rules, and will tell you why unless we are legally prevented from doing so.

Trial and payment

New accounts get a 14 day free trial. We do not ask for a card to start it, and nothing is charged during it.

The trial does not convert into a paid subscription on its own. When it ends, you simply stop being able to create new write-ups until you choose a plan. Your existing write-ups remain readable. There is no automatic charge, and no card on file to charge.

If you choose to subscribe, it is $29 per month or $290 per year, billed in advance through Stripe. A paid subscription does renew automatically until you cancel. You can cancel any time from Settings; access continues to the end of the period you paid for, and we do not prorate partial periods. If you are unhappy in your first 30 days as a paying customer, email us and we will refund you.

Accuracy of generated content — please read this one

Windshield uses automated transcription and artificial intelligence. Transcripts and generated content, including names, dates, amounts, CRM notes, next actions, summaries and follow-up emails, may contain errors or omissions. You are responsible for reviewing generated content and verifying important information before relying on it, sending it to another person, or entering it into another system.

Generated output can be false, incomplete, misleading or inaccurate, and can be wrong in ways that read as entirely plausible. Factual assertions should be independently checked. Windshield is a drafting aid — not a system of record, and not a source of truth.

Availability

We aim to keep Windshield running but do not promise uninterrupted service. We may change or discontinue features. If we shut the service down entirely, we will give at least 30 days notice and a way to export your write-ups.

Termination

You can delete your account at any time from Settings, inside the app. We may suspend or close an account that breaks these terms, and will tell you why unless we are legally prevented from doing so.

Disclaimers and liability

The service is provided “as is”, without warranties of any kind to the extent the law allows. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for lost profits, lost deals or indirect damages.

Governing law

These terms are governed by the laws of the State of Delaware, and disputes will be heard in the state or federal courts located in Delaware.

Changes

We will email account holders before a material change takes effect. Continuing to use Windshield after that means you accept the updated terms.
